World-renowned journalist, death-row inmate and political prisoner Mumia
Abu-Jamal is completely innocent of the crime for which he was convicted.
Mountains of evidence--unheard or ignored by the courts--shows this. He is a
victim, like thousands of others, of the racist, corrupt criminal justice
system in the US; only in his case, there is an added measure of political
persecution. Jamal is a former member of the Black Panther Party, and is
still an outspoken and active critic of the on-going racism and imperialism
of the US. They want to silence him more than they want to kill him.

Anyone who has ever been victimized by, protested or been concerned about
the racist travesties of justice meted out to Blacks in the US, as well as
attacks on immigrants, workers and revolutionary critics of the system,
needs to take a close look at the frame-up of Mumia. He is innocent, and he
needs to be free.

The U.S. COURT OF APPEALS FOR THE THIRD CIRCUIT REJECTS ALL APPEALS FOR
INNOCENT DEATH ROW INMATE MUMIA ABU-JAMAL

STATE OF PENNSYLVANIA ORDERED TO HOLD NEW SENTENCING HEARING WITHIN 180
DAYS. IN SUCH A HEARING JURY'S DECISION WILL BE LIMITED TO A FINDING OF LIFE
IMPRISONMENT OR EXECUTION BY LETHAL INJECTION

"THE DECISION OF THE THIRD CIRCUIT IS A TRAVESTY OF JUSTICE," SAID JEFF
MACKLER, DIRECTOR OF THE MOBILIZATION TO FREE MUMIA ABU-JAMAL. "DESPITE
MASSIVE EVIDENCE OF INNOCENCE THE COURT REJECTED OUR DEMAND FOR A NEW TRIAL
WHERE THE TRUTH COULD BE HEARD FOR THE FIRST TIME."

In a shocking decision, the U.S. Court of Appeals for the Third Circuit
rejected all Mr. Jamal's demands for a new trial. In 1982 Mr. Jamal was
falsely convicted of the murder of Police Officer Daniel Faulkner in a trial
where 11 or 14 Black jurors were systematically excluded and where critical
evidence proving the defendant's innocence was excluded.

On death row for 26 years, Mr. Jamal, an award winning journalist and the
author of nine books, has led a campaign for a new trial and freedom that
has won the support of groups ranging from Amnesty International and the
European Parliament to the San Francisco, Detroit, and Berkeley city
councils.

Jamal's attorneys will appeal today's decision to the U.S. Supreme Court.

Day-after demonstrations are also planned in:

Philadelphia, New York, Chicago, Los Angeles, Toronto, Vancouver
and other cities internationally.

Free Mumia Abu-Jamal!

Internationally renowned journalist and Black activist Mumia Abu- Jamal has, ever since his frame-up by the Philadelphia police in 1981, been demanding a fair trial, a public forum that would hear the overwhelming evidence that clearly establishes his innocence of the murder of Philadelphia Police Officer Faulkner. Waiting for that day when justice would be done, Mumia has sat caged on death row in Pennsylvania for 27 years.

The 3rd Circuit Court of Appeals has just issued a ruling that Mumia is not deserving of a new trail, that, in the words of the AP article, "He should get a new sentencing hearing because of flawed jury instructions. If prosecutors don't want to give him a new death penalty hearing, Abu-Jamal would be sentenced automatically to life in prison." In other words, the only alternatives for Mumia are life in prison or execution.

These are totally unacceptable alternatives! Mumia is innocent and it is a grave injustice that so much of his life has already been stolen from him. Robert Bryan, Mumia's attorney, is not finished with the legal struggle for justice. "I've never seen a case as permeated and riddled with racism as this one," he told the press. "I want a new trial and I want him free. His conviction was a travesty of justice."

Members of the San Diego Mumia Coalition will gather at Euclid and Imperial this afternoon at 4 p.m. to let the community know that Mumia's struggle will continue until he is free.
