NEWS BULLETIN:  ON NOV. 21ST, 2001, COMMON PLEAS STATE JUDGE,  PAMELA DEMBE REJECTS MUMIA'S APPEAL FOR A NEW POST CONVICTION RELIEF HEARING TO PROVE HIS INNOCENCE WITH  VITAL, UNHEARD EVIDENCE.  DEMBE CLAIMS THAT HER COURT HAS "NO JURISDICTION" TO GRANT NEW TRIAL.  MUMIA'S LAWYERS  WILL APPEAL TO HIGHER STATE COURT.

11/27/01--December 9th will mark the 20th anniversary of the unjust  arrest and incarceration of African American journalist  and political prisoner, Mumia Abu-Jamal.

For 20 years, Mumia's case has symbolically represented  resistance against every form of racist and political  repression. And today, his case cannot be separated from  the reactionary atmosphere created by the U.S. government  that wants to use the tragic September 11th attacks to stifle progressive political dissent.  

Thousands of unknown Arab and South Asian young men,  falsely accused of being "terrorists", are being detained  indefinitely and tortured by the FBI and INS. At the same  time, thousands of unknown Black and Latino prisoners are  languishing on U.S. death row, a great majority of them  for the "crime" of being poor.  

As long as one person's civil liberties and civil rights  are under attack, all of our civil liberties and civil  rights are under attack. This is an important aspect of  Mumia's case. Join the international concerned family and friends of  Mumia Abu-Jamal and others on Saturday, December 8 for a  mass demonstration beginning at 12 noon at Philadelphia City Hall (Broad and Market) to demand:  

  • stop the legal lynching of Mumia  
  • grant a new trial to allow all the evidence proving  Mumia's innocence to finally be heard especially the  Arnold Beverly taped confession  
  • end racist profiling including mass detentions, police  brutality and the death penalty

11/29/01--Judge Pamela Dembe has just ruled that she will NOT reopen Mumia's case in her court to hear the evidence that, month after month, continues to come out in his favor. This is a serious move.  

It means that it is all the more important to put the pressure on the court of Judge William Yohn to HEAR THE EVIDENCE IN MUMIA'S CASE, and put it on record. Mumia is near the end of the appeals process, and this evidence, which could lead to overturning his conviction, a new trial, etc., has again and again, been turned down by Pennsylvania and federal courts.

Remember all the evidence you've heard about, since 1995 and before? Things like witnesses recanting, coming forward and telling how police pressured them to lie in court or ran them out of town? Evidence that ballistics in Mumia's case had never been properly tested and that the bullets in Mumia's gun (used during his work as a nighttime cab driver) could not accurately be matched to those that killed Officer Daniel Faulkner? The existence of a third man in the car that Officer Faulkner stopped, who was reported by witnesses but conveniently left out by the police? The recent confession by Arnold Beverly to the murder itself?

None of this evidence has ever been allowed to be entered into the courtroom records. It has all been labeled as irrelevant to the case and thrown out -- which is no surprise, when things happen in this case like the original judge being allowed to come out of retirement to review the appeals to the case, including the evidence that he himself was the most blatantly biased element in the trial.

Does this new ruling mean that Mumia's case is given up for lost? NO. It does mean that people need to GET INVOLVED if they aren't already, and STAY ACTIVE. We still have the power to win this case, save Mumia's life, and protect our freedoms that are up for debate in this case, but we aren't going to have unlimited time to do it. The time is now.
