We are facing a critical moment in the case of Mumia Abu-Jamal, award-winning journalist and Black political prisoner on death row, framed in 1982 for the killing of Police Officer Daniel Faulkner. The various powers who’ve clamored for Mumia’s execution for two decades made their first major concession on December 18, 2001. Twenty years after the original incident of December 9, 1981 in Philadelphia, Federal Judge William Yohn overturned Mumia’s death sentence based on what he interpreted as faulty instructions to the jury in 1982 during the sentencing phase of the trial. But he let the conviction for first degree murder stand. Judge Yohn ruled that at the end of 180 days (mid-June), Mumia will automatically be sentenced to life in prison (without parole!) unless the decision is appealed. Both the prose­cution and Mumia’s legal team have filed appeals. Although completely innocent, Mumia is still on Pennsylvania’s Death Row. Unless we can force the courts to hear the evidence of his innocence, he faces life in prison or a possible new death sentence for a crime he did not commit. Mumia’s life is in more danger than ever before!

Despite overwhelming evidence of prosecutorial, judicial, and police misconduct in his trial, and mounting and powerful evidence substantiating Mumia’s assertion of innocence, the state and federal judicial authorities are determined to keep Mumia in prison or kill him. They can only do this by refusing to hear the previously hidden evidence that Mumia’s attorneys have discovered and presented in both state and federal courts. WE MUST FORCE THE COURTS TO HEAR THE STRONG EVIDENCE OF MUMIA’S INNOCENCE!

A key affidavit confirming Mumia’s innocence is the confession of mob hit man Arnold Beverly to the killing of police officer Daniel Faulkner, the crime for which Mumia was sentenced to death. This confession was found to be highly credible by Charles Honts, a nationally recognized polygraph expert. Former court reporter Terri Maurer-Carter’s affidavit that she overheard Judge Sabo say in 1982, “Yeah, and I’m gonna help ’em fry the n****r!” only confirms the total lack of impartiality we witnessed in Judge Sabo’s courtroom.

Ought we to be silent when the State forces the Voice of the Voiceless to remain caged or possibly silenced forever? Rage is the only possible response to Judge Yohn’s decision. We will not be silenced until Mumia and all Political Prisoners are free!

Judge Yohn’s decision is unjust and unacceptable. 21 stolen years is too long! Let’s bring Mumia home now!

Mumia Abu-Jamal is calling all progressive forces to unite and not allow the racist courts and the U.S. government to "depoliticize" his case.

The December 18th federal district court decision that overturned Mumia's death sentence and not the first degree murder conviction, is a political maneuver to try to keep all of the suppressed evidence that could free Mumia, from seeing the light of day, especially the Arnold Beverly confession. The death penalty could still be reinstated for Mumia depending on the outcome of the state and federal appeals or Mumia could be facing life in imprison without parole, a Pennsylvania law.
