Legal challenges to the trial of Saddam Hussein
Dear Sir, Madam
Lawyers associated with the committee for the defense of former President Saddam Hussein have recently disseminated their detailed conclusions on the political and legal aspects of the trial of Saddam Hussein, e.g. the Dujail Trial.
The released documents highlight gross and endemic violations of the human right to a fair trial. Fundamental rights including the right to an attorney, equality of arms, presumption of innocence, judicial impartiality, and judicial independence constitute but a sample of the casualties occasioned by the establishment of an illegal court in violation of AA 54 and 64 of the Fourth Geneva Convention.
These documents were sent to every head of mission to the United Nations, as well as International Governmental Organizations and Non-Governmental Organizations, in order to increase awareness about the polarizing effects of the trial and request political action so as to prevent Iraq from descending into outright and irreconcilable civil war.
The record also includes substantial expert commentaries and press releases critical of the Dujail trial, as well as a copy of a transmittal letter signed by former Attorney General Ramsey Clark, and can now be accessed at the following:
